Alternative Strategies for Resolving Libel Claims Quickly

Abstract:

The article begins with a discussion of the findings of an empirical study that found a disjunction between the underlying assumptions and goals of media libel law, on the one hand, and the real interests of the parties and what the system actually accomplishes, on the other. The research also indicated that an alternative process would be consistent with the interests of a majority of libel plaintiffs and defendants by providing a more straightforward, less intrusive, and quicker resolution of the dispute. The article describes an experimental, voluntary, nonlitigation alternative program that was created as one potential solution to the problems of the libel litigation system.
