Arizona's New Exemption Statute: Two Views

Abstract:

The thirty-sixth Arizona legislature amended the exemption statutes, which define the items a debtor may keep safe from the reach of his creditors. The new law, Chapter 237 of the 1983 Legislative Session, took effect on July 27, 1983. While it does not create a major new section in the Arizona Revised Statutes, it does make several significant changes in prior laws. It also benchmarks the first of several major legislative efforts by the State Bar’s Creditor-Debtor Committee under the chairmanship of Charles Whitehill of Tucson. This article attempts to highlight the new exemption statute and give some of the legislative history behind a bill which came out of almost two years of subcommittee and committee work.
