Arizona’s Version of the Uniform Fraudulent Transfer Law

Abstract:

The 1990 Arizona legislature adopted its version of the Uniform Fraudulent Transfer Act, including significant non-uniform amendments, replacing the Uniform Fraudulent Conveyance Act, which had been on Arizona’s statute books for 71 years. This article evaluates the changes brought about by this new law and the advantages and disadvantages of the non-uniform amendments adopted by Arizona. It concludes that Arizona has a new fraudulent transfer statute that seems to capture both the national and state concerns in a uniform statute with carefully considered non-uniform amendments at appropriate points. For at least a time, it has improved and clarified Arizona’s law of fraudulent transfers.
