Abstract: This chapter has six major divisions. The first is this introduction, which sets forth the basic structure and scope of the chapter. The second division discusses two interrelated questions: (a ) what do we mean by “online privacy law” and (b) why should ecommerce companies care about it? The third division provides an overview of the laws and legal right to privacy issues in the pre Internet era. The fourth division sets forth the current state of online privacy law, including statutes and regulations at the federal, state, and international levels, and provides descriptions of those legal regimes that have had the most direct impact on online privacy law. The fifth major division, provides a brief overview of recently proposed privacy legislation at the federal and state levels and offers a glimpse into the possible future of online privacy. Finally, in the sixth major division, we offer some practical advice to practitioners with useful checklists and special practical issues to consider.
