Abstract: This article describes legal statistical practice, termed “jurimetrics.” Although a young discipline, jurimetrics is becoming more and more frequent in court rooms. Most courts and attorneys, however, have yet to display a mature understanding of the statistical methods being brought to bear in contemporary litigation. In fact, much of the judicial analysis of statistical evidence is embarrassingly bad. This article exposes instances of such flawed reasoning with the hope of curtailing the propagation of similar errors. It primarily analyzes E.E.O.C. v. Western Electric Company.
