Abstract: The passive voice may be the bane of English teachers and writers everywhere, but from time to time, we all let it creep into our writing. As it turns out, Congress is no exception here. The drafters of the Bankruptcy Code used the passive voice when listing exceptions to the bankruptcy discharge. Interpretation of that language--and the role of the passive voice--was the subject of a recent Supreme Court decision.
